What is the Uniform Commercial Code (UCC)?
Uniform Commercial Code, more commonly known as UCC, is a code developed for uniform filing on personal property throughout the USA. The filing of a UCC Financing statement is what perfects or secures the loan on consumer goods or personal property. UCC filings are indexed by debtor’s name and by file number.
UCC Information
Several important changes occurred in the UCC Division of the Register of Deeds Office on July 1, 2001. On this date, the revised Article 9 of General Statute 25 became effective, impacting all registries in North Carolina.
Please note the following changes affecting UCC filings as of July 1, 2001:
- Only fixture filings are accepted for filing at the County level (Register of Deeds). A UCC fixture filing relates to items that become a part of real estate. Fixture filings are now assigned a book and page number and indexed along with real property documents.
- All other UCC filings must be recorded with the Secretary of State.
- A new national UCC form or facsimile should be used for filings.
UCC forms are available for download via the Secretary of State Website - UCC-1 files on record as of June 30, 2001 will be maintained until June 30, 2008. Fixture filings can be renewed with the new national form. No amendments to non-fixture filings, filed prior to July 1, 2001, will be accepted at the County level (amendments include releases, assignments, continuations, and terminations).
Fee and Payment Information
Fees for the UCC Recordings are as follows:
- UCC-1 $38, $45 if greater than 2 pages + $2/page over 10 pages
- UCC-3 $38, $45 if greater than 2 pages + $2/page over 10 pages
- UCC-11 $30 per debtor name + $1/page for copies
- Termination (Amendment) $38
